**General rental conditions for bicycles and scooters**
By signing the registration form, the following conditions are deemed to have been agreed:
### I. The vehicle and its use
1 **Vehicle information**
By accepting the rented vehicle, the Hirer acknowledges that it and its accessories are in a roadworthy, defect-free and clean condition.
2 **Use of the vehicle**
The Hirer undertakes to use the vehicle only in the usual manner in compliance with the statutory regulations, in particular the road traffic regulations.
– Racing bikes:** These may not be used off the beaten track or for purposes other than those for which they are intended.
– Driving license:** The vehicle may only be driven by the renter.
– Commercial use:** Use of the vehicle in commercial traffic or for illegal purposes is prohibited.
### II Obligations of the Renter
1 **Duty of care**
The Hirer undertakes to treat the vehicle with care and in accordance with the technical regulations and to park it only in a safe place in a locked condition.
2 **Report of defects**
Any defects must be reported to the Rental Firm upon return.
3 **Loss of keys**
If the key is lost, the Tenant shall bear the cost of replacing it.4 **Health and fitness assessment**
The Hirer is responsible for assessing the state of health, fitness and technical ability of the vehicle. This is not a reason for returning the vehicle free of charge.
5 **Parental guardian for minors**
The signature of a parent or legal guardian is required for underage renters.
6 **Obligation to wear a helmet**
The Hirer is obliged to wear a helmet when using the vehicle.
### III. repair
1 **Repair costs**
If a repair becomes necessary, the Rental Firm shall bear the costs if the cause is not due to improper handling by the Hirer or the Hirer’s fault. Otherwise, the Tenant shall be responsible and must reimburse the repair costs.
### IV. Accident and theft
1 **Accident report**
The Hirer is obliged to notify the Rental Firm immediately if the vehicle has been involved in an accident. A written accident report with a sketch must be submitted, which must contain the following information:
– Names and addresses of the persons involved
– Any witnesses
– License plate numbers of the vehicles involved

Theft must be reported immediately to the lessor and the police. The police reference number must be sent to the lessor immediately.

### V. Liability
1 **Liability of the Rental Firm**
The Rental Firm shall only be liable in the event of intent or gross negligence.
2 **Liability of the Hirer**
The Hirer must return the vehicle in the condition in which it was received. He shall be liable for damage resulting from theft or culpable damage during the rental period up to a maximum amount in accordance with the current price list. This limitation of liability shall not apply in the event of intentional or grossly negligent action on the part of the Hirer; in this case, the ancillary damage costs shall also be reimbursed.

The Hirer must return the vehicle to the agreed location during the Rental Firm’s business hours no later than the end of the agreed rental period. Any return outside of business hours shall be at the Hirer’s risk.
2 **Rental extension**
An extension of the rental period requires the prior consent of the Lessor.
3 **Late return**
If the vehicle is not returned on time, the Hirer must pay the daily rental fee for each day or part thereof and compensate for any damage incurred.

The Rental Firm shall be entitled to complain about any defects for which the Hirer is liable within three working days of the return of the vehicle.

### VII. final provisions
1 **Additional agreements**
No further ancillary agreements have been made.
2 **Written form clause**
Amendments and supplements to the contract must be made in writing; this also applies to this written form clause.
3 **Salvatory clause**
Should individual contractual provisions be or become invalid, this shall not affect the validity of the remaining provisions.
